Swiss Chalet case

This is the most-quoted legal case involving superannuation funds. The superannuation fund involved in the case had owned, through various entities, a chalet in Switzerland and a holiday house in Victoria that were used mainly by a member of the fund and his friends for their personal enjoyment. The Administrative Appeals Tribunal ruled in 1995 that the fund was not maintained for the sole purpose of providing retirement benefits to its members. Although the fund in the case was not a SMSF, it is often quoted for its relevance to SMSFs. (See Sole purpose test).
